(hereinafter, “Smartick”), a commerical company incorporated in Spain and registered in the Mercantile Registry of Málaga, volume 4684, section 190, page number MA-102744, with N.I.F. number B-93020808 and registered office at Calle María Orueta 14, Urbanización El Olivar, 29140, Málaga. These conditions (hereinafter “Conditions”) regulate the access, navigation, and use of the Website by its users (hereinafter “User” or “Users” as appropriate).
1. Authorized Use
The access and use of the Website suppose that the User accepts, in their entirety and commits to comply completely with, these Conditions.

The User commits to using the Website only for domestic and private purposes. No commercial use of the Website by the User is authorized.
The User commits to not using the Website negligently or for fraudulent purposes or in order to disobey the Law, as well as not to carry out any conduct that could damage the image, interests, and rights of Smartick or third parties.
The User agrees to not perform any actions that damage, disable or overload, deteriorate or prevent the normal use of the Website, that affect its security or that prevents in any way, the normal use of the Website. In particular, the User agrees not to impersonate another user or person while using the Website. 2. Responsibility
The User acknowledges and accepts that the use of the Website is carried out at all times at their own risk and responsibility, therefore Smartick is not responsible for the misuse, improper use, or use contrary to these Conditions that may be made of the Website.
The User shall be fully liable for any damages arising to Smartick as a result of using the Website in breach of these Conditions and assumes responsibility to hold Smartick and its administrators, staff, agents, and representatives free from any liability they may incur as a result of such breach by the User.
Smartick does not guarantee the availability and continuity of the operation of the Website. If reasonably possible, Smartick will give advance warning of interruptions in the operation of the Website and the services offered through it. Smartick does not guarantee the usefulness of the Website or the services for a specific purpose or activity, nor its infallibility. 4. General
The use of the Website is governed by Spanish law unless the conditions of the User are mandatory to apply to other regulations.
In the event that any of the provisions contained in these Conditions is declared null and void, it will be withdrawn or replaced. In any case, such declaration of nullity will not affect the validity of the rest of the provisions contained in these Conditions.
